Acceptance of these Terms
These Terms and Conditions of Use (“Terms”) constitute a binding agreement between you and Eyren Health S.L. (“Eyren,” “we,” “us,” or “our”) regarding your access to and use of eyren.health, its subdomains, and the functionalities made publicly available through them (collectively, the “Website”).

These Terms govern the use of the Website only. Access to or use of Eyren applications, platforms, or other digital services intended for professionals or patients may be subject to separate terms, conditions, privacy notices, or other agreements.

Policies and notices expressly identified as applying to the Website, including the Privacy Notice and Cookie Policy, form part of the legal framework governing its use.
We may amend these Terms where necessary to reflect legal, technical, operational, or service-related changes. The current version will always indicate the date on which it was last updated. Where changes are material, we will take reasonable steps to provide notice where required by applicable law.
1. The Website and Our Services

Participation in pilots, tests, or limited-access programmes may be subject to invitation, selection criteria, and additional terms communicated separately. The fact that a product or service is provided free of charge during a pilot phase does not mean that it will remain free of charge in the future.
We do not offer the Website in jurisdictions where access to or use of it would breach applicable law or require us to comply with requirements that we have not chosen to undertake. Persons accessing the Website from other jurisdictions are responsible for complying with the local laws applicable to them.
2. Intellectual and Industrial Property
Unless otherwise indicated, we own or license the intellectual and industrial property rights in the Website and in the software, code, databases, functionality, designs, interfaces, text, photographs, graphics, videos, audio, logos, trademarks, trade names, and other materials displayed or used on it (collectively, the “Content”).

10. Governing Law and Jurisdiction
These Terms are governed by the laws of Spain, without prejudice to any mandatory rules applicable based on your status or place of residence.
Where jurisdiction may lawfully be agreed and no mandatory forum applies, the parties submit to the courts of Barcelona, Spain.
If you qualify as a consumer or user, this clause does not limit any mandatory rights or jurisdictional protections available to you under applicable law.
11. Dispute Resolution
Before commencing court proceedings, and provided that doing so does not prejudice the exercise or preservation of any right, the parties will seek in good faith to resolve any dispute relating to the Website or these Terms.
The party raising the dispute may notify the other party in writing, after which the parties will have up to 30 days to seek an amicable resolution.
This provision does not prevent either party from seeking interim relief, applying to a competent authority, or immediately exercising any right where permitted by law or where delay could cause harm.
12. Corrections
Information published on the Website may contain typographical errors, inaccuracies, or omissions.
We may correct, complete, or update such information where necessary, without prejudice to any prior information obligations that may apply by law.

To the maximum extent permitted by applicable law, Eyren will not be liable for indirect, incidental, special, or consequential losses arising solely from the use of or inability to use the Website where such liability may lawfully be excluded.
We are not responsible for decisions made solely on the basis of general informational Website content where such content is not intended to constitute individualised professional advice.
This limitation does not apply to liabilities that may not lawfully be excluded or limited, including, where applicable, liability arising from fraud, wilful misconduct, infringement of non-waivable rights, or any other circumstances established by mandatory law.
Pilots, applications, and specific services may be subject to separate terms governing liability associated with their use.
15. Liability for Misuse
You are responsible for direct damage you cause as a result of unlawful use of the Website or deliberate use in breach of these Terms, to the extent provided by applicable law.
If unlawful conduct attributable to you results in a third-party claim against Eyren, you may be responsible for those costs and losses that are legally attributable to you.
This clause does not impose indemnification obligations on consumers beyond those permitted under applicable law or restrict any non-waivable consumer rights.
16. User Data
We may process and retain information necessary to operate the Website, respond to your requests, maintain its security, and comply with our legal obligations.
Personal data will be processed in accordance with our Privacy Notice and applicable data protection law.
You are responsible for ensuring that information you send to us is appropriate and that you have the right to provide it, without prejudice to our own obligations as a controller or processor where applicable.

We will not be liable for failure to perform caused by force majeure or other events outside our reasonable control, to the extent provided by law.
If any provision is held to be void, invalid, or unenforceable, it will be interpreted or limited to the extent necessary to make it valid where possible, without affecting the remaining provisions.
These Terms do not create any partnership, employment relationship, joint venture, mandate, or agency between you and Eyren.
